NORDIC SMILE™ — TERMS OF SERVICE (NORWAY/EØS COMPLIANT)

Welcome to Nordic Smile™. These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, and related services (“Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must discontinue using the Services.

1. Eligibility and Account Use

By placing an order or using our Services, you confirm that:

  • You are at least 18 years old, or have legal parental/guardian consent.

  • You will provide accurate, complete, and updated information.

  • You are responsible for maintaining the security of your account credentials.

  • You will not share your login details or allow others to access your account.

Nordic Smile is not responsible for loss arising from unauthorized access caused by your failure to secure your device or login details.

2. Our Products

We make every effort to display our products accurately. However:

  • Colors and appearance may vary depending on your device and settings.

  • Packaging and product details may change without prior notice.

  • We reserve the right to limit quantities, discontinue products, or modify listings at any time.

Oral-care products are considered hygiene-sensitive items, and some are return-restricted under the Norwegian Right of Withdrawal Act (Angrerettloven).

3. Orders

Placing an order constitutes an offer to purchase. An order is accepted only when you receive an order confirmation.

We may refuse or cancel an order for reasons including, but not limited to:

  • Payment issues

  • Incorrect pricing

  • Suspected fraud

  • Stock availability

  • Delivery limitations

Your order is governed by these Terms and our Refund Policy.

4. Pricing, Taxes, and Billing

Prices shown on our website are in NOK and include VAT if applicable.

You agree to:

  • Provide accurate and valid payment information

  • Ensure your payment method has sufficient funds

  • Update payment details when necessary

Shipping fees, taxes, and other charges will be shown at checkout before payment.

We reserve the right to adjust prices at any time.

5. Shipping and Delivery

Nordic Smile ships within Norway unless otherwise stated.

  • Delivery times are estimates, not guarantees.

  • Delays caused by carriers, weather, customs, or unforeseen events are outside our control.

  • Risk of loss transfers to you once the package is handed over to the carrier.

If a parcel is returned due to incorrect address, unclaimed pickup, or refusal, return shipping charges may apply.

6. Intellectual Property

All trademarks, logos, designs, product names, text, images, and other content are the property of Nordic Smile or our licensors.

You may not:

  • Copy

  • Modify

  • Reproduce

  • Resell

  • Distribute

  • Reverse engineer

…any part of our website or content without explicit written permission.

7. Third-Party Services

Our store is hosted by Shopify, and the Services may integrate with:

  • Shopify

  • Payment processors (Vipps, Klarna, Stripe)

  • Carrier services

  • Marketing tools

  • Analytics platforms

These third-party providers have their own terms. Nordic Smile is not responsible for their service quality or data handling practices.

8. Consumer Rights (Norway/EØS)

Norwegian and EØS consumers are protected by:

  • Angrerettloven (14-day right of withdrawal)

  • Forbrukerkjøpsloven (Consumer Purchase Act)

  • Markedsføringsloven (Marketing Act)

  • GDPR (Privacy & Data Protection)

Your statutory rights under these laws remain unaffected by these Terms.

9. Returns, Withdrawals & Hygiene Restrictions

Consumers have a 14-day right of withdrawal from the day goods are received.

However, under Angrerettloven §22, the right of withdrawal does not apply to:

✅ Sealed hygiene products once the seal is broken

This includes:

  • Sonic electric toothbrushes

  • Brush heads

  • Plaque/tartar removers

  • Any item intended for oral use

If the hygiene seal is broken, the product becomes non-returnable.

If unopened and sealed, returns are accepted in accordance with our Refund Policy.

10. Product Warranty (Forbrukerkjøpsloven)

Under Norwegian law, consumers may be entitled to a warranty claim for defects that:

  • Were present at the time of delivery, or

  • Appear within a reasonable time frame

This legal warranty is independent of our store policies.

Damage caused by misuse, improper handling, or normal wear is not covered.

11. Errors and Inaccuracies

Occasionally, product listings may contain:

  • Typographical errors

  • Pricing mistakes

  • Incorrect availability

  • Inaccurate descriptions

We reserve the right to correct such errors, including after an order has been placed.

12. Prohibited Uses

You may not use the Services:

  • For unlawful or fraudulent activity

  • To upload malware or harmful code

  • To attempt unauthorized access to our systems

  • To scrape, copy, or harvest data

  • To violate intellectual property rights

  • To interfere with website functionality

Violation may result in termination of access.

13. Termination

We may suspend or terminate your access to the Services at any time if:

  • You violate these Terms

  • Fraud is suspected

  • Required by law

  • Site integrity is threatened

You remain responsible for all charges incurred before termination.

14. Limitation of Liability

To the fullest extent permitted by Norwegian law:

  • Nordic Smile is not liable for indirect, incidental, or consequential damages.

  • Liability for direct damages is limited to the amount you paid for the product in question.

Nothing in these Terms limits statutory rights that cannot legally be waived.

15. Indemnification

You agree to indemnify and hold Nordic Smile harmless from claims or damages arising from your misuse of the Services or violation of these Terms.

16. Governing Law and Disputes

These Terms are governed by Norwegian law.
Disputes shall be resolved by the ordinary courts of Norway.

Consumers may also use:

  • Forbrukertilsynet (Consumer Authority)

  • Forbrukerklageutvalget (Consumer Disputes Commission)

before court proceedings.

17. Changes to the Terms

We may update these Terms at any time.
Changes take effect once published on our website.

By continuing to use the Services, you accept the updated Terms.
